1. Acceptance of Terms
By accessing and using Portus Safe, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
Portus Safe is a platform that connects European citizens (Associates) seeking contingency plans with Brazilian hosts willing to provide temporary accommodation in times of crisis. The service includes:
- Matching Associates with verified Hosts
- Provision of safety guides and legal information
- Access to regional legal support contacts
- Unique validation codes for offline use
3. User Eligibility
3.1 Associates
To register as an Associate, you must:
- Be 18 years of age or older
- Be a citizen of a European country
- Provide accurate and complete information
- Maintain an active subscription
3.2 Hosts
To register as a Host, you must:
- Be 18 years of age or older
- Be a Brazilian citizen with European citizenship
- Provide valid identity, address, and citizenship documentation
- Have the legal capacity to host guests
4. Subscription and Payment
4.1 Subscription Fees
Associates pay a monthly subscription fee of €9 for the primary member, plus €3 for each additional family member (up to 5 total). Payments are processed through Stripe.
4.2 Billing
Subscriptions automatically renew monthly unless cancelled. You will be charged at the beginning of each billing period.
4.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
5. User Responsibilities
5.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5.2 Accurate Information
You agree to provide accurate, current, and complete information and to update it as necessary.
5.3 Prohibited Conduct
You may not:
- Use the service for any illegal purpose
- Provide false or misleading information
- Impersonate another person or entity
- Interfere with the proper functioning of the platform
- Attempt to gain unauthorized access to any part of the service
6. Matching Process
Matches between Associates and Hosts are made automatically based on location, capacity, and availability. We do not guarantee that a match will always be available immediately.
7. No Guarantee of Accommodation
Portus Safe is a contingency planning platform. We facilitate connections but do not guarantee accommodation will be available or suitable in an actual crisis situation. The platform is intended as a preparedness tool, not an insurance policy.
8. Limitation of Liability
To the maximum extent permitted by law, Portus Safe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid in subscription fees in the 12 months preceding the claim.
9. Disclaimer of Warranties
The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
10. Indemnification
You agree to indemnify and hold harmless Portus Safe from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason.
12. Changes to Terms
We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles.
